End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and Epic Pursuits Inc, dba Ludicrous Film and Games ("Company," "we," "us," or "our") governing your use of our video game The Rend: Trials of the Drift, including all software, updates, patches, additional content, and related services provided by us (collectively, the "Game"). By downloading, installing, or playing the Game, you agree to be bound by the terms of this EULA. If you do not agree, do not use the Game.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to install and play the Game for personal, non-commercial use, subject to this EULA. This license does not include any rights to modify, distribute, or reverse-engineer the Game. If you get the Game through Steam, your use is also subject to the Steam Subscriber Agreement. Steam's terms control for your Steam account and Steam's services.
2. Restrictions
You may not:
- Copy, reproduce, or distribute the Game except as expressly permitted by us or as allowed under Section 6 (Content Creation).
- Modify, adapt, or create derivative works of the Game.
- Reverse-engineer, decompile, or disassemble the Game, except where permitted by law.
- Use cheats, hacks, or unauthorized third-party software to alter the Game.
- Sell, rent, lease, or sublicense the Game or your access to it.
3. Ownership
The Game, including all software, code, artwork, music, text, and other intellectual property, is owned by Epic Pursuits Inc, dba Ludicrous Film and Games or its licensors. You do not acquire any ownership rights by using the Game.
4. Pre-release and Closed Builds (If Applicable)
If you are playing a closed or otherwise non-public build, you agree:
- Not to disclose confidential information about that build (for example unreleased features, bugs, or content) to third parties without our written consent. This does not apply to the public Steam demo, public store materials, or other builds we have made public.
- That the Game may be incomplete, unstable, or contain errors, and you use it at your own risk.
If you are playing a public build (including a public Steam demo or Early Access), the confidentiality restriction above does not apply, but the Game may still be incomplete, unstable, or contain errors, and you use it at your own risk.
5. User Content
Any content you create or submit while using the Game (e.g., feedback, bug reports, or in-game creations, but excluding content created under Section 6) grants us a worldwide, royalty-free, perpetual license to use, modify, and distribute it for purposes related to the Game.
6. Content Creation
We grant you a limited, non-exclusive, revocable license to create and publicly share videos, livestreams, or other content featuring gameplay of the Game (e.g., on YouTube, Twitch, or similar platforms), provided you comply with this EULA. You may monetize such content through platform features (e.g., ads, subscriptions), but you may not sell or distribute raw Game assets (e.g., artwork, music, or code) or claim ownership of the Game. If you are playing on non-publicly available builds (like for closed beta testing and playtesting), you must obtain our written consent before streaming or sharing gameplay content, as outlined in Section 4. We reserve the right to request removal of content that violates this EULA or harms the Game's reputation.
7. Termination
We may terminate this license if you breach this EULA. You may stop using the Game at any time by uninstalling it. On termination, you must stop using the Game and delete any copies in your possession. Sections that should survive (including ownership, limitation of liability, and governing law) will survive.
8. Limitation of Liability
To the fullest extent permitted by law, Epic Pursuits Inc, dba Ludicrous Film and Games is not liable for any indirect, incidental, or consequential damages arising from your use of the Game, including loss of data or profits.
9. Governing Law
This EULA is governed by the laws of California, USA, without regard to conflict of law principles.
10. Changes to the EULA
We may update this EULA at any time. Continued use of the Game/Software after changes constitutes your acceptance of the updated terms.
